# Call Him Gay and You Will Pay

We despise bullying and the public school administrators who tolerate it in the name of "toughening up" a kid. But this case is a little scary. A boy was repeatedly taunted for being gay (he isn't, ear ring notwithstanding), and he successfully sued under Title IX.

> The lawsuit was filed under Title IX legislation, which prohibits sexual discrimination in any institution receiving federal funds. The suit said the bullies repeatedly called Theno homosexual names.

> Theno is not gay.

> The jury ruled that the case constituted gender-based harassment and that the school district ignored it. Theno was awarded $250,000.

So if the boy had been bullied for other reasons, he wouldn't have had a valid suit? Only gays or quasi-homosexuals have this protection? Puzzling. We'll try to learn more.
