Call Him Gay and You Will Pay

We despise bullying and the public school administrators who tolerate it in the name of "toughening up" a kid. But this case is a little scary. A boy was repeatedly taunted for being gay (he isn't, ear ring notwithstanding), and he successfully sued under Title IX.

The lawsuit was filed under Title IX legislation, which prohibits sexual discrimination in any institution receiving federal funds. The suit said the bullies repeatedly called Theno homosexual names.
Theno is not gay.
The jury ruled that the case constituted gender-based harassment and that the school district ignored it. Theno was awarded $250,000.

So if the boy had been bullied for other reasons, he wouldn't have had a valid suit? Only gays or quasi-homosexuals have this protection? Puzzling. We'll try to learn more.
